Abstract
As one of the intellectual property, traditional knowledge is an intellectual work that is not getting the special treatment in the law. In fact, the existence of traditional knowledge is very important and has great economic potential for the welfare of society. Therefore, the model must be found to the protection and enforcement of appropriate laws for traditional medicine (herbal medicine) as part of traditional knowledge. In the future, as traditional knowledge in the form of herbal medicine cannot be protected under the Patent Act, it is necessary that the Act specifically provide legal protection for intellectual property in the form of traditional medicine (herbal medicine) of the violations committed by unauthorized parties.
