Abstract

PROBLEMS ARISING IN WELL-KNOWN TRADEMARK LICENSING AGREEMENTS IN INDONESIA Dr. Agung Sujatmiko, SH., MH. Department of Private Law - Faculty of Law – Airlangga University, Surabaya - Indonesia agung.sujatmiko@fh.unair.ac.id agung_sujatmiko@yahoo.com Keywords: agreement, license, trademark, problems. Theme :Trade and Business Presentation Preference : oral ABSTRACT Well-known trademark licensing agreements constitute a means of taking advantage of the trademark owner-s economic rights. To avoid problems that may arise in the future, the parties shall draw up and execute an agreement with full honesty and in good faith. The principle of honesty requires the parties to comply with and obey the agreement, while the principle of good faith requires the parties to execute the agreement in good faith, as the basis for executing the agreement. When these principles are not put into practice properly, it may result in some problems that cause a party to sue another party since their rights are harmed. The agreement is legally binding upon the parties in accordance with the principle of pacta sun servanda, meaning that an agreement shall apply as a law for those who draw it up. Violating the agreement means that the parties deny the agreement. They violate the law indirectly. Thus, a right formula should be sought in a licensing agreement for well-known trademarks in order to prevent the parties from suffering a loss due to a dispute. However, both the licensor as the trademark owner and the licensee have an equal position. Both have a significant role in the execution of the agreement. On that basis, a win-win solution should be sought in case of problems. This research is very useful to support licensing agreement, trade and business.

Baitul Mal wa Tamwil (BMT) emerged as an option for SMEs (small and Macro Entrepreneurships) in Indonesia to obtain loans in a simpler way. BMT is an integrated independent business center and supporting financing of economic activities. Meanwhile, entering the disruptive iinovation era, BMT began to face some problems in its survival and development. This paper aims is to analyses the problems and to give solutions for BMTs in order to collaborate with Islamic fintech in the term of funding as catalyst of SMEs. The methodology of this reserach is a normative method with a conceptual approach and statute approach. As an catalyst, it is needed a synergy from the development of fintech to BMT as a sharia-based microfinance institution to be able to further encourage the growth of SMEs in Indonesia. BMT still has many problems and requires serious monitoring from the Financial Services Authority (OJK) and the Ministry of Coops. Moreover, we still find some illegal BMTs whose do not have licenses yet and/ or their operations are not in accordance with their business permit. Furthermore, still there is a lack of literacy about loan in Islamic business law perspective, Islamic Fintech platform and BMT itself.

Abstract Sumatera Utara is a multicultural region. One of its native tribe is Batak Toba tribe. The people in Batak Toba tribe consumes special drink for a special occasion or as their second nature. Until now, tuak is still a very popular liquor in the area of North Sumatra, you could find a shop called lapo tuak in almost every village. Along with other cultures, tuak is also considered a cultural result that can be included in one of the many traditional drinks which favored by the domestic and foreign tourists. In North Sumatra tuak production is spread in various places, one of them are located in Medan. Medan is the largest metropolitan city outside Java and the third largest city after Jakarta and Surabaya. Despite being one of the largest cities in Indonesia, tuak which produced and being sold in Medan does not have its own branding. The various types of tuak create difficulties in identifying the origin of tuak that sold in the market. Then came the idea to design a brand for tuak, in addition, to increase selling pro-spect, and also to maintain the quality itself (quality control) so that it could be more trusted to the targeted custom-ers. The identity design is followed by making packaging and promotion that is appropriate and effective. By making identity, packaging, and promotion for tuak, it is expected that Toba Bataks tuak can be identified by potential cus-tomers more easily.

Abstract
Copper nanoparticles are one type of metal nanoparticles that have not been widely studied. Copper nanoparticles have some uniqueness that affects their optical, catalysis and conductive properties. In addition, nanoparticles can also be applied in the field of microbiology because of their antibacterial activity. This study aims to determine the optimum conditions for the synthesis of copper nanoparticles, using melinjo leaves extract as bioreductor. This research used copper (II) sulfate as a precursor. Melinjo leaves are extracted with water at 60oC. Beta cyclodextrin was used as a stabilizer. The results showed that the optimum conditions for the synthesis of copper nanoparticles were using a comparison of extracts: CuSO4 solution: beta cyclodextrin 10 mg/mL = 1: 2: 2 (v / v / v). Nanoparticles were synthesized by reflux at 90oC for 4 hours. The optimization results show that the sonication process for 4 hours after synthesis affects the stability of the formed nanoparticles. Copper nanoparticles have an average particle diameter of 682.8 nm and polydispersity index of 0.497.

Abstract
Geomagnetic and Geochemical observations have been conducted to identify the geothermal potential of Mt. Pandan Volcano Hosted Geothermal, East Java, Indonesia. Firstly, the magnetic survey was performed using PPM G-856 and running on 80 magnetic stations that cover an area of 9x10 km2. The measurement stations cover two hot springs, Jari and Banyukuning in the Mt. Pandan. The result showed that total magnetic intensity ranged from 446.7nT to 526.3nT. The residual anomaly of contour map revealed that geothermal reservoir was suspected in an area with low magnetic intensity around the hot spring and identified as the volcanic braccia and tuffaceous sandstone. The tentative model from magnetic residual anomaly can show location, depth, and thickness of the geothermal reservoir. The flow pattern the reservoir to manifestation, show the alleged presence of a secondary structure. This indicates that Jari and Banyukuning manifestation have different reservoirs. Furthermore, the geochemistry method has been done to analyze the characteristics of geothermal fluid in this area. Water sample was collected at two hot spring, Jari (Selo Gajah) and Banyukuning. The geochemical data was process using the spectrophotometric method to analyze the concentration of anion and cations that contained in hot springs water. The Geochemical analysis can identify the type and characteristics of the fluid to estimate the reservoir temperature. The results show that the type of water in geothermal system from mount Pandan area are cloride and bicarbonate water. Meanwhile, the geothermometer analysis for Na-K-Ca shows the average of reservoir temperature is arround 130 C and classified into medium entalphy system.

ABSTRACT Cangar Hot Springs (CHS) located at flank of Arjuno-Welirang Volcano Hosted Geothermal Field in Batu city, East Java has a high potential as pilot project of regional in the frame of Ecotourism and Edu Techno Park development. A few hot spring found in the Arjuno-Welirang volcanic complex, such as Padusan hot spring, Songgoriti hot spring, Kasinan hot spring, and Cangar hot spring. Based on previous Peak Ground Acceleration observations, the area was concluded a safe zone indicated by low seismic index. Furthermore, based on the self potential investigations, the fluid flow around CHS can be predicted that the direction of hot fluid flow spread from southeast to northwest. This results can be used to consider a high potential for Eco tourism of CHS mainly related to the use of hot springs and community education related to volcano hosted geothermal. We develop a concept and observed some aspect to improve the development CHS area as Ecotourism and Edu Techno Park. In addition, the visual observation shows that the occurrence of solfatara and fumaroles with magmatic gasses indicated the existence of a volcanic geothermal system in the subsurface around Arjuno-Welirang volcano hosted geothermal complex. This visual observation can be done direct from the developed Cangar Techno Park area on UniversitasBrawijaya for monitoring of ArjunoWelirang volcanic eruption as part of integrated ecotourism concept and idea to community education for developing of geothermal prospecting area.

Management in the broadest sense is planning, organizing, directing, and controlling or supervising, has been carried out by the leadership of the Islamic Boarding School, even though the level of skill (competence) varies from one another. Even in the process, the leaders of Islamic Boarding School are not only based on the management function, but are also equipped with various other activities based on religious beliefs (practices of the Sunnah) that they believe in. Starting from a high sincerity that is whatever managerial work they do is purely due to God to an attitude of generosity. So, the researchers are not enough to look at the managerial process in the Islamic Boarding School only with the eyes of modern management. Islam does not only talk about theology, but it is a perfect civilization, so globally found values of management regarding work plans, work motivation, ways of working, cooperation, leading, evaluating, controlling, etc., even in ways special ways to be successful in the work program through prayer, dzikir, wirid specifically, mujahadah, riyadhah batiniyah, etc. in order to get taufiq (success in carrying out deeds), hidayah (instructions for running deeds), and ma-unah (help to run deeds deeds) ) from Allah SWT. Thus, in that way, not a few Islamic Boarding School leaders have good managerial competence, so that they successfully manage the educational institutions they lead, both in terms of infrastructure, educational processes, and results achieved; This is recognized by many parties about the success and even its superiority, so that the graduates are also not a few who succeed in the midst of society.

Abstract
This paper discusses the relevance of social interaction and student communication theories with a culture inherent to the students personal. An idealism born from an early culture affects how communication and interaction of one person is. The problems in cultural bias that arise in student interaction and communication are a major concern in seeing how the early cultural roles of the globalization era still affect ones interactions and communication. This paper helps us understand how cultures that are owned on self-counsellors influence the concept of problem solving in the counseling process. The arguments that support these aspects of cultural theory will be explained through the three concepts of a comparative study approach, namely communication in cross-cultural counseling, culture in the organization, and assimilation of cultural/cultural constructions.

Therefore, this research is interesting to do. This research focuses on the track record of Panrita-Anreguru (scholars/ulama) in Sinjai on a historical-synchronic basis. For this purpose, a historical methodology is adopted, namely: Heiristics, Source Criticism, Source Analysis, and Interpretation. It was found that early in the XVII century Islam was accepted by the Sinjai people. Since then, Islamization has been dynamic and massive. That was due to the collaboration of local scholar and Ruler. Eventually, a figure called Panrita (Expert) or Anreguru (Great Ulama) was born. The mastery of religious knowledge and Panritas skill in transmitting the knowledge, gave birth to a new term namely Anreguru (Great Ulama). Abstract
In the last 10 years, Mount Bromo has erupted three times; 2010, 2015 and 2019. However, it is unique that Tengger peoples are reluctant to evacuate even though Mount Bromo is erupting and releasing volcanic material such as stones and dust. Mount Bromo itself is a mountain made by caldera with an area about 10 square kilometers. This makes Mount Bromo relatively safe while an eruption occurs because volcanic material with a large size and weight will fall around the caldera, only dust that is blown by the wind will be continued as far as miles from the crater of Bromo which depends on the direction of the wind. Using the smartphone application as the Mount Bromo information facilities is one of an effort so that people and tourists can activate if an eruption occurs. There is important information about features made in the application such as shelters distribution, evacuation routes, health centers, photos, videos, and other important informations. Assesment results to the application interface, the information conveyed, and also the features offered show that the application is very useful and gives a new perspective in conveying accurate information to the public and also tourists. The level of community satisfaction is also quite good with the services provided by the Bromo preparedness application. Great expectations from the public and also respondents can see Mount Bromo further through CCTV cameras that are directly connected to the Android application.
